Our Services, Order at Website, Pricing, and Payment 

The Services shall include –

  2. procuring logistics support preferably another entity experienced with collection and transportation of the purchased products for delivery to the User;
  3. our “Customer Support” enables the Users to contact at marketing@alsaadfurniture.com or call 06 5953255 with any queries that the Users may have about the purchase of the products or purchased products. 

All prices on the Website are displayed. The User agrees to pay the full amount payable for the respective product as indicated during the order process including any shipping costs, any charges, and taxes incurred with the order. 

We will not accept the User’s order for products if  – 

  1. the item is out of stock; 
  2. there is a product or pricing error; 
  3. we are unable to obtain authorisation for payment; 
  4. we have shipping restrictions/limitations for the User’s location; 
  5. at our sole discretion for any other reason. 

Please note, we will inform the User that the order has not been accepted and any related payment will not be processed. We will not be liable to the User or any third party for our decision to decline to process the order or suspend any transaction after processing has begun.

If we notice any errors in pricing on the Website or during order processing due to any reason, without any admission, we will, in good faith, try to resolve the issues that may arise as a result of such errors. The User agrees to cooperate with us to resolve such issues and accepts that we will have sole and full discretion to determine the appropriate resolution. 

All the products listed on the Website will be sold either at Maximum Retail Price (MRP), inclusive of all taxes, or at a discounted price, including all taxes, unless otherwise specified. Prices and taxes in respect of the products are subject to change from time to time without prior notice by us. Please note the online prices may not match with offline prices at a store due to many reasons. The User hereby accepts and agrees that the User shall not raise any dispute for the same. In a case where the User gets invoiced/charged/billed erroneously at a price higher than MRP printed on the product package, the User shall call our Customer Care for a refund of the difference as per our policy.

While availing payment options made available on the Website, we will not be responsible or assume any kind of liability in respect of any kind of loss or damage arising directly or indirectly to the User due to – 

  1. lack of authorisation for any transaction; or 
  2. any payment issue arising out of the transaction; or

We may offer multiple payment options for the convenience of the customers including but not limited to the debit card, credit card, net banking, UPI, etc. Please note acceptance of card payment is at the sole discretion of the Company and we may ask the User to submit a copy of photo identity proof or any other documents. We reserve the right to add, modify, or remove such payment options without prior notice. All usage of payment options on the Website shall at all times be subject to rules, regulations, and guidelines under the applicable laws, issuer banks, facility providers, and other intermediaries involved in payment process mechanism.

We evaluate buying and returning behavior’s of the Users/Customers and reserve the right to process the transaction to Users/Customers with a prior history of questionable charges including without limiting breach of any agreements with the User/Customers of the Company or breach/violation of any law or breach of any policy.

We reserve our right, at our sole discretion, and without prior notice, to limit the quantity/value of items purchased per person or per household, or per order. These restrictions may be applicable to order placed by the same account, same debit/credit card, or net banking channel, or the orders that use the same billing or shipping address.

Discount e-coupons

Any use of discount e-coupons shall be subject to this T&C and the terms and conditions issued for each individual e-coupons. We will honor the e-coupons when it is used following this T&C and individual e-coupons terms. All discount e-coupons shall be the property of the Company and not transferable, the same cannot be resold and have no cash alternatives. Each e-coupon shall carry an expiry date and after the expiry date, the coupons can no longer be used by the User. We reserve the right to cancel or reject the use of an e-coupon where fraud or illegal use is suspected. The User shall have no claim against any such rejection or cancellation by us. 

Shipping 

The User understands and accepts that the correct and accurate postal or shipping address is a must for a timely delivery. The User shall be solely responsible for providing the correct and accurate postal or shipping address for delivery of the purchased products. 

The risk of loss and title for the purchased products shall pass to the User on delivery of the purchased products by our Logistic Partner.

We are not responsible for any delays in the shipping of the purchased products, loss, or missing purchased product, or incorrect delivery of the purchased product which is due to the User’s fault or due to inaccurate, wrong, false, or incomplete information provided by the User.

Return, Refund, And Cancellation

Refunds for User’s/Customer’s order returns (whether total or partial), and Cancellations (whether total or partial) shall be processed as per our “Return Refund And Cancellation Policy”. All payments made by the User/Customer will be refunded as per the “Return Refund And Cancellation Policy” If the User/Customer thinks that we have provided an incorrect refund, please contact immediately marketing@alsaadfurniture.com or call 06 5953255.

The User/Customer can cancel the orders up to 24 hours.  The User/Customer can call Customer Care within operational hours, i.e., 9:30 AM to 6:30 PM ( Monday to Saturday).

Under no circumstances and under no legal or equitable theory or otherwise, shall the Company or any of its affiliates, group companies, suppliers, employees, directors, officers, and agents be liable to the User or to any third party for any direct, indirect, special, incidental or consequential losses or damages of any nature including, without limitation damages for loss of profits, loss of goodwill, loss of data, losses due to work stoppage, losses because of business interruption, losses due to accuracy of results, losses caused by computer failure/malfunction even if the Company’s authorized representative has been advised of or should have known the possibility of such damages due to –

Assignment

This T&C and any rights and licenses granted herein may not be transferred or assigned by the User in any manner whatsoever without the prior written consent of the Company. However, the same may be assigned by us without restriction.

Display: we have made all efforts at our disposal to display the products as accurately as possible; the product image, the look, and feel, more particularly the product color that appears on the Website. However, the display units (for instance, computer monitors in the case of computers) vary and we cannot give a guarantee that the User’s display unit will give any color to be the accurate or exact color.

Product Description: we attempt to be accurate on the product description with the information at our disposal. However, we do not warrant that the product description is accurate, complete, reliable, current, and error-free. 

Force Majeure: we shall not be held liable for any delay or failure in the performance of any part of the T&C due to any cause beyond our control and without our negligence or fault on our part, viz., acts of God; any act of civil or military authority; laws, regulations, or rules and any changes therein from time to time; embargoes; epidemics; war; terrorist acts; riots; insurrections; fire; explosions; natural calamity; man-made accidents (for instance, nuclear accidents); strikes; power failures or blackouts; political unrest; other major environmental disturbances; unusual severe weather conditions; acts of hackers and other illegal activities of third parties; non-availability of products or services due to any reason; non-availability of transportation facility due to any reason; any acts or omissions of transportation or telecommunication; acts, omissions, over loadings, slowdowns of the internet or any third party internet service provider.

Hyperlinks: any link or reference of other websites on the Website is merely for the convenience of the User and we are not responsible for the content, operation, privacy practices, or otherwise of such linked sites on the Website. We hereby declare that we do not endorse, promote, or represent such sites in any manner. As a User, the User shall use the linked sites at his/her own risk and consequences.

Intellectual Properties: we own and have control or have the license of the copyright, trademark, and all other intellectual properties contained in the Website. All product names, trade names, service names, logos, tag lines, or otherwise, are intellectual properties owned by us or licensed to us. The intellectual properties on the website are variously protected by the law of India and other countries. No one shall use any of these intellectual properties without the prior written approval of AL SAAD FURNITURE. We expressly reserve all intellectual property rights in all materials which appear on the Website. 

No License: access to the Website shall not be considered as conferring upon anyone any license by us whether for our intellectual property or intellectual property of any third party licensed to us.

Right to Alter or Improve: we reserve the right to correct any error or omission in the Website including but not limited to improving the contents of the Website, anytime, without any prior notice. Further, we also reserve the right to alter, limit, or discontinue any product or services on the Website, any time, without any prior notice. We shall not be liable for any modification, termination, suspension, or discontinuation of the Website. 

Suspension or Termination of User’s Account: we may suspend or terminate a User’s Account, either wholly or partially, without any prior notice, in our sole discretion, if we have reasons to believe that the User violates this T&C or any applicable law or is harmful to the interest of the Company or a third party. We shall not be liable to the User or any third party for any such suspension or termination of the User’s Account.

Use of Cookies: the cookies are small records/files which are closed on the user’s browser to collect information about the User’s activities on the Website for preparing reports, assessing trends, and otherwise for monitoring the way the Website is used, etc. We may use cookies or other technologies on the Website. We use cookies to enhance convenience for the User and to enable us to run an effective and effective operation. The User accepts that the User hereby gives his consent to the use of cookies and other similar technologies by us. 

Offensive Materials/Contents: the User understands that while using the Website the User may encounter material/content that may be felt by some User to be offensive, indecent, not acceptable, or objectionable while the material/content may not be identified as such. The User, further, agrees that the use of the Website shall be at the User’s sole risk and we (including our affiliates or group companies) shall have no liability to the User for such materials/contents as mentioned in this paragraph.  

User Confirmation: if the User is not the consumer then the User hereby confirms, agrees, and accepts that the User has the authority to bind any person (whether natural or artificial) on whose behalf the User is using the Website.

Severability: if any terms and/or conditions of this T&C are held to be unenforceable for any reason, such provision shall be reformed to the extent necessary to make it enforceable and the other terms and/or conditions of the T&C shall remain in full force. 

Waiver: any failure on our part concerning a breach of these T&C by the Users or others does not constitute a waiver and shall not limit our rights concerning such a breach or any subsequent breaches.

Unauthorized Use: any unauthorized use of the Website may give rise to a claim for damages and/or a criminal offense.

Relationship: the User acknowledges and agrees that no joint venture, partnership, employment, or agency exists between the user and AL SAAD FURNITURE.

No Agreement No Use: if the User does not agree or cannot comply with any of these T&C, the user is requested not to use the Website.
